1. Introduction
These Terms of Service (“Terms”, “Terms of Service”) govern your use of our website located at www.conciergeexpresstt.com (together or individually “Service”) operated by Concierge Express.
Our Privacy Policy also governs your use of our Service and explains how we collect, safeguard and disclose information that results from your use of our web pages.
Your agreement with us includes these Terms and our Privacy Policy (“Agreements”). You acknowledge that you have read and understood Agreements, and agree to be bound of them.
The Company reserves the right to modify the terms and conditions of this Agreement or its policies relating to the Service and Software at any time, effective upon posting of an updated version of this Agreement on the Service or Software. You are responsible for regularly reviewing this Agreement. Continued use of the Service or Software after any such changes shall constitute your consent to all such changes.
If you do not agree with (or cannot comply with) Agreements, then you may not use the Service, but please let us know by emailing at team.conciergeexpresstt@gmail.com so we can try to find a solution. These Terms apply to all visitors, users and others who wish to access or use our Service.
2. Definitions
In these Terms and Conditions, where the following terms are used, they shall have the following meanings:
“Concierge Express” means the Company, we, our, us
“Agreement” means these Terms and Conditions together with the Service Order.
“Collection Point” means the address at which a Consignment is received or collected by us.
“Consignment” means any item(s) which are, may be, or are intended to be, received by us from any sender at an address for us to carry and deliver to any recipient at any other address.
“Damaged Consignment” means a Consignment that is no longer in the condition in which it was received by us, or which is or becomes a health and safety risk.
“Delivery Point” means the address to which a Consignment is delivered by us.
“Excepted Risks” means:
(i) war, invasion, act of foreign enemy, hostilities (whether war be declared or not), civil war, rebellion, revolution, insurrection or military or usurped power, or loot, sack or pillage in connection;
(ii) ionising radiations or contamination by radioactivity from any nuclear fuel or from any nuclear waste from the combustion of nuclear fuel;
(iii) radioactive, toxic, explosive or other hazardous properties of any explosive nuclear assembly or nuclear component of the same;
(iv) pressure waves caused by aircraft and other aerial devices travelling at the speed of sound or faster; and/or
(v) the absence, failure or inadequacy of the packing or packaging used for a Consignment.
“No Protection Item” means a Consignment that is carried without Parcel Protection for damage or loss and at your risk.
“Out of Gauge” means a Consignment which is outside of the weight and dimension ranges that we carry on a particular Service.
“Prohibited Item” means any item which cannot be carried on any Service.
“Purchase” means when you accept the Service Order.
“Returned to Sender” a Consignment may be returned to sender (i.e. to us) if the recipient sends it back to us and:
(i) you do not accept receipt of that Consignment;
(iii) you do not pay any outstanding charges; and/or
(iii) if the Consignment is delivered and is Out of Gauge, for which you nor the recipient pay the underpayment.
If your parcel is returned to Parcel2Go due to us being unable to deliver your consignment we will endeavor to make reasonable efforts to contact you to arrange the return of your parcel.
Parcel2Go reserve the right to charge for this return. If we are unsuccessful in our attempts to contact you regarding the return we will make arrangements to dispose of your consignment 28 days after contacting you.
“Service” means the service and carriage of a Consignment by us in accordance with the Service Order.
“Service Order” means the summary of the order, which is displayed during the ordering process, which is confirmed to you in the confirmation email that we send once we have accepted your order.
“Us, We or Our” means Parcel2Go.com Limited, together with its directors, employees any agents subcontractors or couriers acting on its behalf.
“You” means the customer, who is contracted with us, as set out in the Service Order.
Items for Delivery
Permitted items that can be sent for delivery:
- Couriers can only deliver items that a normal or reasonable human can carry which is 30 lbs.
- Your courier will be on car, van, SUV or by panel van.
- Your courier may refuse to accept oversize, overweight, illegal items as depicted below.
Restricted items that cannot be sent for delivery:
- Animals
- People
- Illegal items
- Fragile items that are not packaged to prevent breakage, shifting or collapse
- Very expensive or rare items
- Dangerous goods such as:
- Explosives
- Firearms
- Flammables, etc
- Stolen goods
- Any items which you do not have permission to send
If your courier refuses an item due to weight and size or because it is a restricted item, or because the courier is asked to purchase or transfer funds a cancellation fee will apply to you. Additionally, your business rating will be affected which you may be removed from the ParcelPal network. Couriers may refuse to deliver goods at their sole discretion. Couriers will NOT purchase or transfer funds at any time for delivery purposes.
Alcohol Delivery
Users must be at least 18 years of age and must show 2 pieces of ID. The user of the ParcelPal app must be at the delivery location to receive the items. By agreeing to our terms and conditions you are agreeing to ID verification and understand that if these rules are not met penalties may ensue. Penalties: $10 cancellation fee will be charged if the courier has been dispatched to collect your order. You will not be charged the delivery fee or the convenience fee. If a user cancels their order after the courier has picked up the items they will be charged the full amount of the order.If you are underage you will be charged the full amount of your order plus an additional $10 penalty and you will not receive the items. If you place an order and are not available to receive the delivery you will be charged the full amount of your order plus an additional $10 penalty and you will not receive the items.
Delivery Guarantee
ParcelPal will guarantee damaged, lost or stolen items up to $250, with the exception of the aforementioned restricted items.
Tracking of your Parcel
You can follow your package on the ParcelPal Application or the web portal. ETA (estimated time of arrivals) are estimates and subject to change. GPS could be inaccurate, or not available if the courier’s reception is out.
Internet Delays
The company’s service and software may be subject to limitations, delays, and other problems inherent in the use of the internet and electronic delivery communication system. The company is NOT responsible for delays, failures, or other damages resulting from such issues.
Custody of Parcels
There must be someone at the delivery address to receive your item(s). The ParcelPal courier will wait a maximum of 5 minutes and return the package back to the original destination. The following must occur in order to complete a delivery:
If you would like to waive the verification process, a text message confirmation through the mobile app with response is required. Liability of the package will be on the requestor (you). If no one is at the location and the verification process is waived, the courier will return the package to the original sending location and the requestor (you) will be charged the delivery fee + a returning fee + cancellation fee.
Cancellation and Order Fulfillment Policy
If no one is present at your pickup location, or the package is not ready, a cancellation fee will apply.
If no one is present at your delivery location, the courier will wait for a maximum of 10 minutes before returning the item. Requestor (you) will be responsible as mentioned.
Any delivery that has no contact at the delivery location must provide details on location to leave the package and a text message stating that no contact is available.
If no one is present at the delivery location and the requestor (you) are also unavailable, the requestor will be responsible. The courier will leave item and original pickup location and requestor (you) will be responsible for fee’s incurred.
Limitation of Liability
In no event will the company’s aggregate liability exceed the amounts actually paid by and/or due from you in the (6) month period immediately preceding the event giving rise to such a claim. In no event shall the company and/or it’s licensors be liable to anyone for any indirect, punitive, special, exemplary, incidental, consequential or other damages of any type or kind such as:
Personal injury
Revenue
Loss of data
Profit
The quality of the courier service used through ParcelPal’s software is the responsibility of the third-party provider who provides such services to you. You therefore understand that by using the software and the service your parcels may be exposed to situations that are potentially dangerous, offensive, harmful, unsafe and that you use the software at your own risk.
Relationship between ParcelPal Couriers and the Company
If you are delivering for ParcelPal, you are an independent contractor and you are not an employee, owner, joint venture, partner or agent of the Company and that there absolutely no employment agreement between you and the company.
Termination of Agreement
This Agreement is effective upon the use of the Software or the Service. You or the Company may terminate your participation in the Service at any time, for any reason and the Company may prohibit your use of the Software or Service at any time in its sole discretion. The terms of this Agreement, and any subsequent modification of this Agreement, shall remain in effect at all times after you or the Company terminate your participation or access to the Software or Service.
By using the Concierge Express website, software and technology, you warrant that you:
Are legally capable of entering into binding contracts
You are at least 18 years old
